These Terms of Service ("Terms") constitute a legally binding agreement between you and Caring Consulting Co. LLC regarding your use of Caring CourseForge. By accessing or using our service, you agree to be bound by these Terms.

Welcome to Caring CourseForge. These Terms govern your access to and use of our AI-powered course creation platform, including all content, features, and services we provide. These Terms apply to all users, including free and paid subscribers.

1. Definitions

For purposes of these Terms:

  • "Service" means Caring CourseForge, including our website, platform, applications, and all related services
  • "Content" means text, graphics, images, courses, lessons, quizzes, and other materials available through the Service
  • "User Content" means content you create, upload, or generate using our Service
  • "AI-Generated Content" means content created by our AI features based on your inputs
  • "We," "Us," "Our" refers to Caring Consulting Co. LLC and Caring CourseForge
  • "You," "Your" refers to the individual or entity using the Service

2. Account Registration and Eligibility

2.1 Eligibility

You must be at least 13 years old (or 16 in the EU) to use our Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

2.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Ensuring your account information is accurate and up-to-date

3. Acceptable Use Policy

3.1 Permitted Use

You may use the Service to:

  • Create, edit, and manage educational courses
  • Generate course content using our AI features
  • Export courses in SCORM and web formats
  • Collaborate with team members (on applicable plans)
  • Integrate with learning management systems

3.2 Prohibited Activities

You agree NOT to:

  • Violate any applicable laws, regulations, or third-party rights
  • Use the Service to create content that is illegal, harmful, threatening, abusive, or otherwise objectionable
  • Infringe upon intellectual property rights of others
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Transmit viruses, malware, or other malicious code
  • Use automated systems (bots, scrapers) without our written permission
  • Resell, redistribute, or sublicense access to the Service
  • Use the Service to train competing AI models or services

4. Intellectual Property Rights

4.1 Your Content Rights

You retain all ownership rights to your User Content. By using the Service, you grant us a worldwide, non-exclusive license to host, store, process, and display your content as necessary to provide the Service.

4.2 AI-Generated Content

Content generated by our AI features is owned by you. However, you acknowledge that:

  • AI may generate similar content for different users
  • AI-generated content may not be subject to copyright protection in all jurisdictions
  • You are responsible for reviewing and validating AI-generated content

4.3 Our Rights

We own all rights to the Service, including our software, algorithms, designs, trademarks, and other intellectual property. You may not copy, modify, distribute, or create derivative works based on the Service.

5. Subscription Plans and Billing

5.1 Plan Types

We offer multiple subscription tiers:

  • Free Plan: Limited features for individual use
  • Professional Plan: Full features for power users
  • Team Plan: Collaboration features for teams
  • Enterprise Plan: Custom solutions for organizations

5.2 Billing

  • Subscriptions are billed monthly or annually in advance
  • All fees are in US Dollars unless otherwise stated
  • You authorize us to charge your payment method for all fees
  • Failed payments may result in service suspension
  • No refunds for partial months or unused portions of service

5.3 Price Changes

We may change our pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.

5.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access until that date.

6. AI Features and Limitations

6.1 AI Content Generation

Our AI features are designed to assist with content creation. However:

  • AI-generated content may contain errors or inaccuracies
  • You are responsible for reviewing and validating all AI-generated content
  • We do not guarantee the accuracy, quality, or appropriateness of AI-generated content
  • AI features are subject to usage limits based on your plan

6.2 AI Training

We may use anonymized, aggregated data to improve our AI features, but we will not use your specific User Content to train AI models without your explicit consent.

7. Data and Privacy

7.1 Data Collection

We collect and process data as described in our Privacy Policy. By using the Service, you consent to our data practices.

7.2 Data Security

We implement industry-standard security measures to protect your data. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

7.3 Data Export and Deletion

You may export your content at any time. Upon account deletion, we will delete or anonymize your personal data within 30 days, except where required by law to retain it.

Our Service may integrate with third-party services (e.g., learning management systems, payment processors). Your use of these services is subject to their respective terms and policies.

9. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Guarantee

We do not guarantee that:

  • The Service will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The Service is free of viruses or harmful components
  • Results obtained from the Service will be accurate or reliable

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM
  • SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU

You agree to indemnify and hold harmless Caring Consulting Co. LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights

12. Termination

12.1 Termination by You

You may terminate your account at any time through your account settings or by contacting support.

12.2 Termination by Us

We may suspend or terminate your access to the Service:

  • If you violate these Terms
  • If required by law
  • If we discontinue the Service
  • At our discretion, with or without notice

12.3 Effect of Termination

Upon termination:

  • Your right to use the Service ceases immediately
  • We may delete your account and data after 30 days
  • You remain liable for any fees owed
  • Sections that by their nature should survive termination will survive

You agree to resolve disputes on an individual basis only. You waive any right to participate in class action lawsuits or class-wide arbitration.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign these Terms without our written consent. We may assign these Terms to any successor or acquirer.

15.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet disruptions.

17.1 FERPA Compliance

If you use the Service in an educational setting subject to FERPA, we agree to comply with FERPA requirements as a "school official" with legitimate educational interests.

17.2 COPPA Compliance

If you create courses for children under 13, you are responsible for obtaining verifiable parental consent and complying with COPPA requirements.

18. Accessibility

We strive to make our Service accessible to all users. If you encounter accessibility barriers, please contact accessibility@courseforge.com.

19. Export Restrictions

You agree not to export or re-export the Service in violation of U.S. export control laws and regulations.

20. Acknowledgment

BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM.
